The civil litigation process is both time consuming and expensive. Often it takes two to three years to bring a matter to trial. Moreover the whole process is governed by a complex set of procedural and evidentiary rules. A civil trial matter encompassing the pleadings stage, discovery and a three day trial often will cost in excess of $25,000.00.

Arbitration provides a time saving and cost effective alternative to the formal trial process. Often a dispute can be resolved by arbitration within six months from the commencement of the filing of the claim. Moreover arbitration has limited appeal opportunities giving greater finality to judgments.

Arbitration requires that the disputants submit their dispute to an arbitrator. Both sides should agree on the Arbitrator, or alternatively request the BCAMI appoint an arbitrator. Once the specific issues in dispute have been identified a hearing will be held at which the disputants may or may not want to call witnesses and present their case much as you would at a formal trial. The major difference is that at an arbitration hearing the rules of evidence are more relaxed and hearings tend to me more informal and much less intimidating than appearing before a judge in the Supreme Court. Procedural rules are also much more relaxed and less time consuming. Finally, and most importantly the disputing parties control the process—not the courts.
